Privacy Policy

This Privacy Policy describes how Perkifi Inc. (“Perkifi,” “we,” “us,” or “our”) collects, uses, shares, and protects information in connection with your use of the Perkifi platform, website, and related services (collectively, the “Service”). By using the Service, you agree to the collection and use of information as described in this Policy.

1. Information We Collect

1.1 Information You Provide

  • Account registration data: name, email address, organisation name, billing address
  • Payment information: processed by our third-party payment processor; Perkifi does not store full card numbers
  • Social media handles and profile URLs you submit for analysis
  • Communications you send us (e.g., support requests, waitlist sign-ups)

1.2 Information Collected Automatically

  • Usage data: pages visited, features used, agent runs initiated, session duration
  • Device and browser information: IP address, browser type, operating system
  • Cookies and similar tracking technologies (see Section 7)
  • Log data: error logs, API request logs, timestamps

1.3 Information from Third Parties

  • Public social media data from platforms such as Instagram, TikTok, YouTube, X, Facebook, and LinkedIn, retrieved via public APIs or licensed data sources
  • Data from analytics partners and ad networks used to improve the Service

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and improve the Service
  • Process transactions and manage subscriptions
  • Generate analytics reports and AI-driven insights
  • Send transactional emails (account confirmation, receipts, security alerts)
  • Send product updates and marketing communications, where you have consented or where permitted by law
  • Detect, prevent, and respond to fraud, abuse, and security incidents
  • Comply with legal obligations and enforce our Terms of Use
  • Conduct internal research and development to improve our AI models and platform

4. How We Share Your Information

4.1 Service Providers

We share data with trusted third-party vendors who assist us in operating the Service, including cloud hosting providers, payment processors, email delivery services, and analytics platforms. These providers are contractually required to protect your information and use it only as directed by us.

4.2 Business Transfers

In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you before your data is transferred and becomes subject to a different privacy policy.

4.3 Legal Requirements

We may disclose your information if required to do so by law, court order, or governmental authority, or if we believe in good faith that such disclosure is necessary to protect our rights, your safety, or the safety of others.

4.4 Aggregated and De-identified Data

We may share aggregated, de-identified, or anonymised data that cannot reasonably be used to identify you — for example, industry benchmark statistics or platform-level engagement trends.

4.5 No Sale of Personal Data

We do not sell, rent, or trade your personal information to third parties for their own marketing purposes.

5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide the Service. We also retain data as necessary to comply with legal obligations, resolve disputes, and enforce our agreements. When data is no longer needed, we securely delete or anonymise it.

Upon account deletion, we will delete or anonymise your personal data within 90 days, unless we are required to retain it for legal or compliance purposes.

6. Your Rights and Choices

Depending on your location, you may have the following rights with respect to your personal data:

  • Access: request a copy of the personal data we hold about you
  • Correction: request that we correct inaccurate or incomplete data
  • Deletion: request that we delete your personal data, subject to legal retention requirements
  • Portability: receive your data in a structured, machine-readable format
  • Objection: object to processing based on legitimate interests
  • Restriction: request that we restrict processing in certain circumstances
  • Withdraw Consent: where processing is based on consent, withdraw it at any time without affecting prior processing

7. Cookies and Tracking Technologies

We use cookies and similar technologies (e.g., pixels, local storage) to:

  • Keep you logged in and remember your preferences
  • Understand how users interact with the Service (analytics)
  • Measure the effectiveness of our marketing

You can control cookie settings through your browser or our cookie preference centre. Note that disabling certain cookies may affect the functionality of the Service. We do not respond to “Do Not Track” signals at this time, as there is no agreed industry standard for doing so.

8. Data Security

We implement industry-standard technical and organisational measures to protect your personal data against unauthorised access, alteration, disclosure, or destruction. These include encryption in transit (TLS/HTTPS), encryption at rest, role-based access controls, and regular security audits.

No method of transmission over the internet is 100% secure. In the event of a data breach that affects your rights, we will notify you as required by applicable law.

9. International Data Transfers

Perkifi is operated from the United States. If you are accessing the Service from outside the US, your information will be transferred to and processed in the US. For transfers from the EEA or UK, we rely on appropriate safeguards such as Standard Contractual Clauses approved by the European Commission.

10. California Privacy Rights (CCPA / CPRA)

If you are a California resident, you have the following additional rights:

  • Right to Know: request disclosure of the categories and specific pieces of personal information we have collected
  • Right to Delete: request deletion of your personal information, subject to certain exceptions
  • Right to Correct: request correction of inaccurate personal information
  • Right to Opt Out of Sale / Sharing: we do not sell or share personal information for cross-context behavioural advertising
  • Right to Limit Use of Sensitive Personal Information: we do not process sensitive personal information beyond what is necessary to provide the Service
  • Right to Non-Discrimination: we will not discriminate against you for exercising your CCPA rights

11. Children's Privacy

The Service is not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If you believe we have inadvertently collected data from a child, please contact us at legal@perkifi.com.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email or through a prominent notice on the Service and update the Effective Date above. Your continued use of the Service after the effective date constitutes your acceptance of the updated Policy.
