If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

Perkifi is an AI-powered social media intelligence platform that provides brands, creators, and talent managers with analytics, risk assessment, trend discovery, and partnership matching tools across major social media platforms. The Service includes:
- Omnichannel performance analytics across Instagram, TikTok, YouTube, X (Twitter), Facebook, and LinkedIn
- Brand safety monitoring and real-time risk flagging
- Influencer vetting and partnership risk analysis
- Viral trend discovery and content intelligence
- Collaboration matching and outreach support
- Creator media kit generation and profile management
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice.
3. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of a business entity, you represent that the entity is duly formed and in good standing under applicable law.
4. Account Registration
4.1 Account Creation
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated.
4.2 Account Security

4.3 One Account Per User
Each individual or organisation may maintain only one active account unless otherwise agreed with Perkifi in writing. We reserve the right to terminate duplicate accounts.
5. Permitted Use and Restrictions
5.1 Permitted Use
Subject to these Terms, Perkifi grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business or personal purposes.
5.2 Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation
- Scrape, crawl, spider, or otherwise extract data from the Service in an automated manner without our prior written consent
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
- Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure
- Use the Service to transmit spam, malware, or any other harmful content
- Impersonate any person or entity or misrepresent your affiliation
- Resell, sublicense, or otherwise commercialise access to the Service without our express written consent
- Use AI outputs generated by the Service to train competing machine learning models
6. Intellectual Property
6.1 Perkifi IP
All content, technology, trademarks, and materials comprising the Service — including but not limited to software, algorithms, databases, reports, and design elements — are the exclusive property of Perkifi Inc. or its licensors and are protected by applicable intellectual property laws.
6.2 Your Content
You retain ownership of any data, handles, or content you input into the Service (“User Content”). By inputting User Content, you grant Perkifi a limited, non-exclusive, royalty-free licence to process and use that content solely to provide the Service to you.
6.3 AI-Generated Reports
Reports and analyses generated by the Service are provided for your internal use only. You may share outputs with your clients or partners in the ordinary course of business, provided you do not represent them as independently verified data or remove Perkifi attribution where present.
7. Subscription, Fees, and Payment
7.1 Plans
Perkifi offers free trial access and paid subscription plans. Details of current plans and pricing are available at perkifi.com/pricing.
7.2 Billing
Paid subscriptions are billed in advance on a monthly or annual basis, as selected at checkout. All fees are non-refundable except as expressly set out in these Terms or required by applicable law.
7.3 Free Trial
If you sign up for a free trial, you may use the Service for the trial period without charge. At the end of the trial, your account will automatically convert to the selected paid plan unless you cancel before the trial expires.
7.4 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.
7.5 Price Changes
We may change our pricing at any time. For existing subscribers, changes will take effect at the next renewal date following at least 30 days' notice.
8. Third-Party Data and Social Platforms
The Service integrates with third-party social media platforms (e.g., Instagram, TikTok, YouTube). Your use of those platforms is governed by their respective terms of service. Perkifi is not responsible for the accuracy, availability, or changes to data sourced from third-party platforms. We do not guarantee that any particular platform's data will be available through the Service at all times.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PERKIFI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
AI-generated analytics, risk scores, and recommendations are provided for informational purposes only and should not be relied upon as the sole basis for business, legal, or financial decisions. Perkifi does not guarantee the accuracy, completeness, or timeliness of any data or report.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PERKIFI'S TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE FEES PAID BY YOU TO PERKIFI IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).
IN NO EVENT SHALL PERKIFI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. Indemnification
You agree to indemnify, defend, and hold harmless Perkifi and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.
12. Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 6, 9, 10, 11, and 14 survive termination.
13. Modifications to Terms
We may update these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the Effective Date above. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
14. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings conducted in English. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Perkifi regarding the Service and supersede all prior agreements.
15.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
15.3 No Waiver
Failure to enforce any provision of these Terms does not constitute a waiver of our rights.
15.4 Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. Perkifi may assign these Terms freely.
